Terms of Service

By installing or using Swing Deck you agree to these terms. Read them. They are short on purpose.

1. What Swing Deck is

Swing Deck is a decision-support tool, not an investment adviser, broker, or autotrader. It shows you your own data through a disciplined lens. It does not know your financial situation and cannot tell you what to buy or sell. All trading decisions are yours alone.

2. No investment advice

Nothing in the dashboard, the framework docs, the scoring outputs, or any communication from us constitutes a recommendation to buy, sell, or hold any security. You are responsible for your own diligence. Past performance does not predict future results.

3. Broker integration — read it twice

Swing Deck can write stop-loss order modifications to your E*Trade account when you explicitly enable BROKER_WRITES_ENABLED=true. Before that flag ever goes to live mode you must:

• Run at least one week in dryrun with clean logs.
• Confirm the 4 safety guards (preview/place parity, rate limit, circuit breaker, staleness check) are all green.
• Acknowledge that a bug in the tool could cause incorrect stop orders. You accept responsibility for reviewing every order preview before placing.

We are not liable for trading losses, including those caused by software bugs, data provider errors, network outages, or broker API failures. Run in dryrun first. Always.

4. Subscriptions & refunds

• Paid plans auto-renew monthly or yearly at the price shown at checkout.
• Cancel any time in the Stripe customer portal (link is in every receipt email). Cancellation takes effect at the end of the current billing period.
• 14-day refund: email support@swing-deck.com within 14 days of your first charge for a full refund, no questions asked. After 14 days, prorated refunds on cancellation.
• We may change pricing with at least 30 days notice. Existing subscribers keep their current price through the end of their next billing cycle.

5. Acceptable use

Don't:

• Share your license key with others — it's single-user. Multiple concurrent sessions will trigger a warning and eventually suspend the key.
• Reverse-engineer the cloud API or attempt to validate keys without a subscription.
• Use the product for market manipulation, wash trading, or any illegal activity.
• Abuse the alert system to spam yourself or others — rate limits apply.

6. Uptime & availability

The local dashboard is designed to work offline. The cloud API (license validation, alert dispatch, billing) targets 99.5% uptime but we make no guarantees. License validation caches for 24 hours with a 7-day offline grace period, so short outages don't affect you.

7. Warranties & liability

The software is provided "as is", without warranty of any kind. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or trading losses under any circumstance.

8. Governing law

These terms are governed by the laws of Delaware, USA. Any dispute goes to binding arbitration in Delaware unless prohibited by your local law.

9. Changes

We'll email you at least 30 days before material changes. Continued use after the effective date means you accept the new terms. If you don't, cancel for a refund.
